Four individuals conducting illegal quarrying were arrested in a latest NBI – Environmental Crime Division and Mines and Geosciences Bureau Region IV-A operation in Sitio Tagbak, Brgy. San Rafel, Rodriguez, Rizal last March 9, 2017.

On March 6, 2017, this Office has requested assistance from the NBI-EnCD to help secure the premises of Radthien for safe conveyance of the seized evidence during previous apprehension on November 23, 2016 situated in the subject area.

On March 9, 2017, the team proceeded to the subject area to conduct transfer of previously seized evidence. Upon gaining entry at the compound, the team chanced upon a truck which is in the process of transporting extracted earth minerals taken from the illegal mining area. A close inspection shows a truck-full of extracted minerals about to be transported out of the area with truck’s engine running, although the truck stopped moving as soon as the offenders saw the presence of the team. At the same time, a backhoe excavator previously seized is also being operated for the purpose of gathering minerals from the upper portion of the illegal mining site.

The team believed that offenses were being committed in their presence, having established probable cause that the offenders were the persons responsible for the illegal mining operations. Therefore, the subject offenders were then apprised of their constitutional rights under the circumstances, and they were subsequently placed under arrest at the same day for violation of Section 103 (Theft of Minerals) of RA 7942, otherwise known as the “Philippine Mining Act of 1995.”

It was also noted that several units of equipment and volumes of illegally sourced minerals were missing in the area which was previously seized during November 23, 2016 operation. The team believed that the aforementioned equipment and minerals were taken by the illegal operators.

On the same day, MGB IV assisted by the NBI-EnCD on securing the previously seized evidences and transported the same to the municipal impounding area located at Rodriguez, Rizal.

The individuals involved are now facing charges of Violation of Section 103 (Theft of Minerals) of RA 7942.
